TERMS OF USE

These Terms of Use (“Terms”) govern access to and use of the website bsrealty.eu, including its subdomains, features, services, tools, professional accounts, listing services, advertising services and related functionality (collectively, the “Platform”).

By accessing or using the Platform, creating an account, providing information, publishing or submitting a property listing, purchasing a subscription or promotional service, or otherwise using BS Realty services, you agree to these Terms.

If you do not agree to these Terms, you must not use the Platform.

1. ABOUT BS REALTY

BS Realty operates an online real estate platform that performs informational, advertising and technological functions and enables users to interact with professional participants in the real estate market, including real estate agencies, agents, brokers and property developers.

The Platform may include properties located in the European Union, European Economic Area, United Kingdom, United Arab Emirates, Türkiye and other jurisdictions supported by BS Realty.

Unless expressly stated otherwise, BS Realty is not:

  • the owner or seller of properties advertised on the Platform;

  • a landlord or tenant;

  • a real estate agency representing a buyer or seller;

  • a real estate broker acting in a property transaction;

  • a property developer;

  • a property valuer or appraiser;

  • a mortgage lender, bank or financial adviser;

  • a legal, tax or investment adviser;

  • a party to agreements entered into between users and third parties.

BS Realty provides the technological infrastructure through which property information may be published, discovered by users and used to establish contact between interested parties.

Legal relationships directly connected with a particular property or transaction arise between the relevant parties to that transaction and not with BS Realty, unless BS Realty expressly agrees otherwise in a separate written agreement.

BSREALTY is a registered trademark. All rights to the BSREALTY trademark, trade name, logos and related brand elements belong to the relevant rights holder and are protected by applicable intellectual property laws.

Use of the BSREALTY trademark, logos or other brand elements without the prior written permission of the rights holder is prohibited, except where expressly permitted by applicable law.

2. ELIGIBILITY TO USE THE PLATFORM

Publicly available sections of the Platform may be used to search for and view properties subject to these Terms.

Registration is required to access certain functionality.

Professional accounts and property publishing functionality are available only to professional users who meet BS Realty requirements, including:

  • real estate agencies;

  • authorised real estate agents or brokers acting on behalf of an eligible professional participant;

  • property developers;

  • other professional real estate organisations expressly approved by BS Realty.

BS Realty may request information or documents reasonably necessary to verify the identity, authority, professional status or registration details of a professional user.

3. PRIVATE PROPERTY OWNERS

Private individuals are not permitted to independently publish property listings on the Platform as professional advertisers and may not purchase professional subscriptions, listing services or advertising services intended for agencies and developers.

BS Realty may, however, allow a private property owner to create or submit information about a property for the purpose of obtaining professional assistance with its sale or rental.

Such submission of information does not itself constitute publication of a listing on the Platform.

A private property owner may use functionality provided by the Platform to create and submit information about a property to a professional participant in the real estate market.

BS Realty does not distribute such submissions among agencies, agents, brokers or property developers and does not determine which professional participant should accept a particular property, where the selection or direction of the submission is carried out by the user through the functionality provided by the Platform.

BS Realty provides only the technical means for transmitting information and is not a party to the relationship between the private property owner and the relevant professional participant.

The decision to accept a property, the terms of cooperation, commission, marketing arrangements, execution of a brokerage agreement and subsequent publication of a listing are determined directly by the relevant professional participant and the property owner.

A property may be published on the Platform only after the relevant professional participant has accepted the property and published or approved the listing in accordance with Platform procedures.

Submission of information through the Platform does not constitute an agreement with BS Realty and does not guarantee that any agency or other professional participant will accept the property.

Any brokerage, representation, commission or other agreement subsequently entered into between a property owner and an agency is separate from BS Realty and is governed by the terms agreed directly between those parties.

4. PROFESSIONAL ACCOUNTS

A user may be required to create an account in order to use listing, lead enquiry, subscription management, advertising and other professional services.

Users must provide accurate, current and complete information.

Professional users are responsible for:

  • maintaining the confidentiality of login credentials;

  • all activity carried out through their account;

  • ensuring that access to an agency or developer account is provided only to authorised persons;

  • keeping company and contact information up to date;

  • promptly notifying BS Realty of suspected unauthorised access.

An account may not be sold, transferred or made available to an unrelated third party without BS Realty’s permission.

BS Realty may introduce account verification procedures and request supporting documents both during registration and subsequently.

5. PROPERTY LISTINGS

Only authorised professional users may publish property listings.

The professional user publishing a listing is responsible for its content and accuracy.

A listing must contain truthful and sufficiently accurate information about the property.

The professional user must have the legal right or appropriate authority to advertise the property.

Users must not knowingly publish:

  • fictitious properties;

  • unavailable properties while representing them as available;

  • misleading prices;

  • materially inaccurate property characteristics;

  • fraudulent investment opportunities;

  • photographs unrelated to the advertised property;

  • material infringing intellectual property rights;

  • discriminatory or unlawful content;

  • duplicate listings intended to manipulate search results;

  • malicious links or software;

  • content primarily intended to improperly redirect users away from the Platform in violation of applicable BS Realty rules.

BS Realty may establish additional listing quality standards and technical requirements.

6. ACCURACY OF PROPERTY INFORMATION

Property information displayed on BS Realty may be provided by agencies, brokers, developers and other third-party sources.

BS Realty does not independently inspect every property and does not guarantee the absolute accuracy, completeness or current status of every listing.

Property availability, price, area, measurements, specifications, ownership information, construction stage, estimated completion date, rental conditions, taxes, fees and other information may change.

Before purchasing, selling, renting or investing, users should independently verify information that is material to the relevant transaction.

A professional user must update or remove a listing when it becomes aware that the information is materially outdated or the property is no longer available.

BS Realty may mark a listing as inactive, outdated, reserved, sold, rented or otherwise unavailable where appropriate.

7. INFORMATIONAL CONTENT ON THE PLATFORM

Any articles, reviews, news, analytical content, reference materials, guides, descriptions of countries, regions and real estate markets, information concerning taxation, financing, legislation, investments, procedures for purchasing or renting property, and other informational materials published on the Platform that do not relate directly to a specific property listing are provided solely for general informational purposes.

BS Realty aims to keep such information useful and up to date but does not guarantee its absolute accuracy, completeness, currency or applicability to a particular user’s circumstances.

Such materials must not be regarded as a source guaranteeing one hundred percent accuracy and do not replace independent verification by the user.

Information may change without prior notice, including as a result of changes in legislation, administrative practice, tax rules, market conditions, banking requirements, property registration rules or other circumstances.

To the extent permitted by applicable law, BS Realty is not responsible for decisions made solely on the basis of such general informational materials.

Before taking legally or financially significant action, users should independently verify current information with relevant public authorities, banks, lawyers, tax advisers or other competent professionals.

8. INTERNATIONAL REAL ESTATE

Real estate laws, licensing requirements, taxation, ownership restrictions, registration procedures, immigration requirements, financing rules and transaction procedures vary significantly between jurisdictions.

The availability of a property on BS Realty does not mean that a particular user is legally entitled to purchase, own, rent, finance or otherwise participate in a transaction involving that property.

Users are responsible for obtaining appropriate independent professional advice in the relevant jurisdiction.

9. LEADS AND ENQUIRIES

The Platform provides technical tools that enable users to contact professional real estate participants regarding properties and related services.

Where a user submits an enquiry, contact request, viewing request or other communication relating to a specific listing, that communication is sent to the relevant professional user associated with that listing in accordance with the functionality of the Platform.

BS Realty does not distribute such enquiries or potential clients among agencies, agents, brokers or property developers and does not decide which professional user should receive a specific enquiry where the destination of that enquiry is determined by the user or by the relevant listing.

BS Realty provides only the technical infrastructure necessary to transmit such an enquiry.

BS Realty is not a party to subsequent communications between the user and the professional participant and does not control how an enquiry is handled after it has been transmitted to the relevant recipient.

BS Realty does not guarantee:

  • that a professional participant will respond;

  • a response within any particular period;

  • continued availability of a property;

  • that a viewing will take place;

  • that an agreement will be concluded;

  • completion of any transaction;

  • the quality or content of subsequent communications between the parties.

Professional users are independently responsible for handling enquiries and potential clients received through the Platform.

Processing of personal data in connection with such enquiries is additionally governed by the BS Realty Privacy Policy and applicable data protection law.

10. COMMUNICATIONS

Users may receive communications relating to enquiries, account activity, properties, Platform functionality and services they use.

Professional users receiving enquiries through the Platform must use personal data obtained through such enquiries only for lawful purposes and in accordance with applicable data protection and electronic communications laws.

Information about potential clients must not be unlawfully sold, disclosed to third parties, systematically harvested or used for unrelated unsolicited marketing.

11. SUBSCRIPTIONS

BS Realty may offer paid subscriptions to eligible professional users, including real estate agencies and property developers.

Available plans, prices, billing periods, included features and applicable limits are displayed on the Platform or agreed separately with BS Realty.

Subscriptions may include a specified quantity or level of:

  • active listings;

  • professional account functionality;

  • agency or developer profiles;

  • enquiry management tools;

  • promotional tools;

  • enhanced visibility features;

  • other professional functionality.

Available features and limits depend on the subscription selected.

Unless expressly stated otherwise at the time of purchase, the subscription price does not include separately purchased advertising or additional promotional services.

12. PAYMENT AND RENEWAL

Applicable prices and payment terms are displayed before purchase or established in a separate commercial agreement.

Where a subscription renews automatically, the applicable automatic renewal conditions must be presented to the user during the subscription process.

Where recurring payments are used, professional users are responsible for maintaining a valid payment method.

BS Realty may suspend access to paid functionality where payment is overdue or unsuccessful.

Taxes, including VAT where applicable, are charged or treated in accordance with applicable tax rules and the information shown at checkout or on the relevant invoice.

13. CANCELLATION OF SUBSCRIPTIONS

A professional user may cancel a subscription in accordance with the available cancellation functionality or the commercial terms applicable to that subscription.

Unless otherwise required by applicable law, the subscription description or a separate agreement, cancellation prevents future renewal but does not retrospectively cancel a paid subscription period that has already begun.

Any right to a refund is determined by the applicable subscription terms, mandatory law and the circumstances of the relevant payment.

14. PROMOTED AND FEATURED LISTINGS

Professional users may purchase additional visibility for eligible listings.

Promotional services may include:

  • featured listings;

  • visually highlighted listings;

  • priority placement;

  • premium positions;

  • advertising positions;

  • other methods of increasing visibility.

Purchasing a promotional service does not guarantee any particular number of impressions, enquiries, potential clients, property viewings or completed transactions unless BS Realty expressly provides such a guarantee in writing.

BS Realty may identify promoted content with an appropriate designation.

15. ADVERTISING

BS Realty may display advertising and sponsored content.

Advertising may include materials from:

  • banks;

  • mortgage and other financing providers;

  • insurance providers;

  • property developers;

  • real estate businesses;

  • providers of services related to real estate;

  • other lawful advertisers.

The display of advertising does not constitute endorsement or recommendation by BS Realty unless expressly stated otherwise.

Users are independently responsible for evaluating products and services offered by advertisers.

Financial advertising is informational and promotional content only and does not constitute financial, credit, mortgage or investment advice by BS Realty.

Any loan, mortgage, insurance or other financial product is provided subject to the terms and eligibility requirements of the relevant provider.

BS Realty may reject, suspend or remove advertising that violates applicable law, these Terms, advertising requirements or Platform rules.

16. SEARCH RESULTS AND RANKING

The order in which properties are displayed may be influenced by a range of factors, including relevance to search criteria, location, listing characteristics, freshness, completeness, quality indicators, paid promotion status and other Platform ranking factors.

Paid promotion may affect visibility or placement where appropriately identified.

BS Realty does not guarantee any particular ranking or position in search results.

BS Realty may modify its search and ranking systems to improve the Platform, prevent manipulation or address operational requirements.

17. USER CONTENT

Users may submit information, photographs, property descriptions, logos, documents and other material to the Platform (“User Content”).

Users retain any intellectual property rights they hold in their User Content.

By submitting User Content, the user grants BS Realty a non-exclusive, worldwide, royalty-free licence, for as long as reasonably necessary to provide, operate and promote the Platform and the relevant listing or service, to host, store, reproduce, technically format and adapt, publish, display and distribute such User Content through BS Realty services.

The user represents that it has all rights and permissions necessary to submit and permit such use of the User Content.

This licence does not transfer ownership of User Content to BS Realty.

18. PHOTOGRAPHS AND MEDIA

Professional users must hold all necessary rights to photographs, videos, floor plans, visualisations, logos and other media they upload.

Users must not upload copyrighted material without the permission of the rights holder or another lawful basis.

BS Realty may resize, compress, crop or otherwise technically process media to the extent reasonably necessary for Platform presentation and performance.

19. INTELLECTUAL PROPERTY OF BS REALTY

The Platform, including its design, software, interfaces, branding, logos, database structure and original BS Realty content, is protected by applicable intellectual property laws.

BSREALTY is a registered trademark.

The BSREALTY trademark, related logos, graphic elements, trade names and other brand assets may not be used without the prior written permission of the relevant rights holder, except where expressly permitted by law.

Except where permitted by law or expressly authorised by BS Realty, users may not reproduce, distribute, sell, license, commercially exploit or create unauthorised derivative products from BS Realty materials.

Nothing in these Terms transfers ownership of BS Realty intellectual property to a user.

20. AUTOMATED ACCESS, SCRAPING AND DATA EXTRACTION

Except where expressly permitted by BS Realty in writing or required by applicable law, users must not:

  • systematically scrape property listings from the Platform;

  • use bots, crawlers or other automated tools to extract data;

  • create or maintain an unauthorised copy of the BS Realty listing database;

  • systematically download photographs or property descriptions;

  • use Platform content to create a competing real estate database or service;

  • bypass technical access restrictions;

  • circumvent rate limits or security measures;

  • use automated systems in a manner that imposes a material burden on the Platform.

Search engines and other services expressly authorised by BS Realty may access the Platform in accordance with applicable technical instructions.

Nothing in this section limits rights that cannot lawfully be excluded by contract.

21. PROHIBITED USE

Users must not use the Platform to:

  • commit fraud;

  • impersonate another person or organisation;

  • publish unlawful content;

  • infringe intellectual property rights;

  • distribute malicious software;

  • attempt unauthorised access to accounts or systems;

  • manipulate Platform metrics or search ranking;

  • artificially generate enquiries or traffic;

  • collect personal data without a lawful basis;

  • send unsolicited communications;

  • circumvent subscription or payment restrictions;

  • interfere with Platform security or operation;

  • use the Platform in violation of applicable sanctions, anti-money laundering requirements or other mandatory laws.

22. NON-DISCRIMINATION

Users and professional advertisers must comply with all applicable requirements concerning non-discrimination and equal treatment in housing and real estate.

Listings, advertisements and communications must not contain unlawful discrimination based on characteristics protected by the law applicable to the relevant property, advertiser or transaction.

BS Realty may remove content or restrict an account where there are sufficient grounds to believe that the relevant content violates applicable anti-discrimination law or Platform rules.

23. CONTENT MODERATION

BS Realty may review content submitted to the Platform and take proportionate action where applicable law, these Terms or Platform rules are violated.

Depending on the circumstances, BS Realty may:

  • request correction;

  • restrict visibility;

  • refuse publication;

  • remove a listing or other content;

  • temporarily restrict certain functionality;

  • suspend an account;

  • terminate an account.

BS Realty may also take action in response to valid legal orders, instructions from competent authorities or sufficiently substantiated reports of illegal content.

Where required by applicable law, BS Realty will provide affected users with information regarding moderation decisions and available means of redress.

24. REPORTING ILLEGAL CONTENT AND INFRINGEMENTS

Users and third parties may report suspected illegal content, fraudulent listings, intellectual property infringements and other violations to:

A report should contain sufficient information to identify the relevant content and explain the basis of the complaint.

BS Realty may request additional information reasonably necessary to assess the report.

25. ACCOUNT SUSPENSION AND TERMINATION

BS Realty may suspend or terminate an account where reasonably justified, including where:

  • these Terms are materially or repeatedly violated;

  • there are grounds to suspect fraudulent activity;

  • false professional information has been provided;

  • required payments remain unpaid;

  • the account creates a security risk;

  • the Platform is being misused;

  • continued access would violate applicable law.

Where appropriate and legally required, BS Realty will take into account the circumstances of the violation and the proportionality of the restriction.

A user may stop using the Platform at any time and may request closure of its account, subject to outstanding contractual and payment obligations, legal requirements and applicable record-retention duties.

26. THIRD-PARTY SERVICES AND LINKS

The Platform may contain links to or integrations with third-party websites and services.

Third-party services operate under their own terms and privacy practices.

BS Realty is not responsible for third-party websites, services or products merely because they are accessible through or advertised on the Platform.

27. NO PROFESSIONAL ADVICE

Information on the Platform is provided for property discovery and general informational purposes.

Nothing on the Platform constitutes legal, financial, tax, mortgage, investment, valuation or other regulated professional advice from BS Realty.

Before making significant real estate or financial decisions, users should obtain independent professional advice appropriate to their particular circumstances.

28. NO GUARANTEE OF TRANSACTION

BS Realty does not guarantee:

  • the sale or rental of any property;

  • completion of any transaction;

  • availability of financing;

  • the legal or physical condition of a property;

  • the identity, solvency or reliability of another user or professional participant;

  • the profitability or future value of a property;

  • any particular quantity or quality of enquiries or potential clients;

  • any specific commercial result from a subscription or advertisement.

Users independently make commercial and legal decisions concerning property transactions and related agreements.

29. PLATFORM AVAILABILITY

BS Realty aims to provide a reliable service but does not guarantee uninterrupted or entirely error-free availability of the Platform.

The Platform may be temporarily unavailable due to maintenance, updates, security incidents, technical failures, failures of third-party infrastructure or circumstances outside BS Realty’s reasonable control.

BS Realty may modify, add or discontinue functionality where reasonably necessary for the operation or development of the Platform.

30. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the maximum extent permitted by applicable law, BS Realty is not liable for losses arising from:

  • inaccurate information supplied by third parties;

  • decisions made solely on the basis of property listings;

  • decisions made solely on the basis of informational materials published on the Platform;

  • negotiations or agreements between users and professional participants;

  • acts or omissions of agencies, brokers, developers, advertisers, banks or other third parties;

  • defects in a property or title-related issues;

  • failure of a transaction to complete;

  • unauthorised access to an account resulting from a user’s failure to protect account credentials;

  • temporary interruption of the Platform due to circumstances outside BS Realty’s reasonable control.

Additional liability provisions for paid professional services may be set out in the applicable subscription terms or a separate commercial agreement.

31. LIABILITY OF PROFESSIONAL USERS

To the extent permitted by applicable law, a professional user is responsible for claims, losses and reasonable costs arising from unlawful listings or advertising submitted by that user, User Content submitted by that user, infringement of third-party rights or a material breach of these Terms.

This provision applies only to the extent that the relevant claim or loss is attributable to the acts or omissions of the professional user.

32. PRIVACY AND PERSONAL DATA

BS Realty processes personal data in accordance with its Privacy Policy and applicable data protection legislation.

The Privacy Policy is a separate document and describes, among other matters, categories of personal data processed, purposes and legal bases of processing, recipients of personal data, international transfers where applicable, retention periods and data subject rights.

Professional users receiving personal data through enquiries may have their own independent obligations under applicable data protection law.

33. COOKIES AND SIMILAR TECHNOLOGIES

The Platform may use cookies and similar technologies for essential functionality, security, preference storage, analytics and, where permitted by law and subject to appropriate consent, advertising.

Further information is provided in the BS Realty Cookie Policy and the relevant consent management interface.

34. CHANGES TO THESE TERMS

BS Realty may amend these Terms where reasonably necessary, including in connection with:

  • changes to Platform functionality;

  • the introduction of new services;

  • changes in applicable law;

  • security requirements;

  • operational or commercial changes.

The current version of these Terms will be published on the Platform with an updated revision date.

Where applicable law or an agreement with a professional user requires advance notice of material changes, such notice will be provided.

Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

35. GOVERNING LAW

These Terms and the relationship between BS Realty and professional users are governed by the laws of the Republic of Estonia, unless mandatory provisions of applicable law require otherwise.

These Terms do not restrict the application of mandatory legal provisions that cannot lawfully be excluded by agreement.

36. DISPUTES

In the event of a dispute or complaint, users are encouraged to contact BS Realty first so that the matter may be reviewed and, where possible, resolved.

In disputes between BS Realty and professional users, the courts of the Republic of Estonia shall have jurisdiction to the extent permitted by applicable law and unless otherwise provided in a separate written agreement between BS Realty and the relevant professional user.

These Terms do not restrict statutory rights or dispute resolution mechanisms that cannot lawfully be excluded by contract.

37. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.

Where possible, the affected provision shall be interpreted or limited only to the minimum extent necessary to make it lawful and enforceable.

38. NO WAIVER

If BS Realty does not enforce a provision of these Terms on any particular occasion, this does not constitute a permanent waiver of that provision or any other right of BS Realty.
